The new European Toy Safety Directive 2009/48/EC came into force on July 20, 2011. It replaces the previous Directive 88/387/EEC.

The Directive covers any product designed or intended, whether or not exclusively, for use in play by children under 14 years of age.

The Directive applies to all such items newly introduced to the market on or after July 20, 2011. Items that were already on sale at that date can continue to be sold and distributed under the previous Directive.

Under the new Directive manufacturers are obliged to make available Declarations of Conformity for each such item first placed on the market on or after July 20, 2011 to demonstrate their conformity with the new Directive. There will be one declaration per item, and the declaration will remain valid until such time as new harmonised standards become applicable. At such time, a new declaration will be issued, but the original declaration will remain valid for the items it pertains to, which can continue to be sold.

We are obliged to maintain such declarations for 10 years following the introduction of a new product. Declarations of Conformity are not required for items already on sale before July 20, 2011.

Enesco has developed an electronic filing system for these declarations. This website will enable our customers to quickly and effectively search for a declaration using the product item number. Please remember that declarations are only available for those products that are considered to be toys or children’s products.
